District has paid lunch worker under investigation

Embattled San Benito High School Food Attendant Nancy Polizzi has been paid her normal salary by taxpayers since she was put on administrative leave 11 weeks ago, according to records released by the district.

Superintendent Stan Rose provided details of Polizzi's last three monthly pay receipts, showing payments totaling $2,763.43 paid in three checks in March, April and May, according to the documents released in response to a California Public Records Act request by the Free Lance.

For the last month, Rose had declined to release the information, citing it as "personnel matters" despite a recent California Supreme Court decision requiring that salary information for all publicly funded employees remain open to the public.

Late Monday, Rose responded to a California Public Records Request by having Polizzi's pay receipts delivered to the Free Lance office.

Polizzi was put on leave from her job at SBHS after testifying in the San Jose murder trial of Francisco Vega on March 27.

On the stand she said she unknowingly gave Vega and Joshua Joseph - both convicted for the 2006 murder of David Owens - money used to purchase the .22 caliber handgun Joseph used to shoot Owens to death in his San Jose apartment. She has said Joseph told her he had planned to buy CDs with the money, but she noted to the Free Lance how she knew he probably wouldn't use it for that.

Polizzi also said in court and to the Free Lance that Joseph told her "David is dead" not long after she confessed to him about her sexual relationship with Owens. She said she thought Joseph might "beat up" Owens but was not concerned that he was planning a murder.

She also admitted she was sexually involved with both the Owens and Joseph - who is her stepson - and to giving Joseph $1,000 to start a marijuana operation.

Polizzi has not been criminally charged in relation to the murder, and Santa Clara County Deputy District Attorney Daniel Carr has said he is undecided on whether to prosecute. Carr did not returned phone calls this week from the Free Lance seeking comment.
