San Juan Bautista City Council members made no decisions at Tuesday's meeting about the future of HellBent Motorcycles.
City Manager Steve Julian said the decision was taken off the agenda due to threat of litigation from HellBent's attorney, who sent a letter threatening litigation.
HellBent owner Ray Shott said there was "a very organized group that came in for us." He also said police were there for the council meeting.
"I think they are working on an answer right now," he said, adding that attorneys for both sides are in communication to come up with a solution.
Shott is seeking a conditional-use permit to keep his shop open because it operates in a mixed-use zone and his business falls under the industrial zoning jurisdiction. A conditional use permit would allow him to operate in the mixed-use zone.
HellBent was issued a business license for motorcycle sales and service in June, but City Planner Matthew Sundt said the business was "inadvertently handed out a license" incorrectly.
Shott said "only the owner of the property can apply for a conditional-use permit." He added that no one has applied for such a permit in the past four years.
