Accused child killer banned from contact with husband

Cheryl Busch, accused of shooting and killing her 19-month-old daughter Nov. 19, made a brief court appearance today during which a jude granted an order keeping her away from her husband while defense attorney Greg LaForge and Deputy District Attorney Anna Marie Padilla agreed on a continuation to set the preliminary hearing date.

Busch is charged with first-degree homicide in the shooting death of her 19-month-old daughter Donna Busch. She was arrested after telling a 911 operator, according to a transcript, that she had killed her child. Law enforcement arrived to find the toddler deceased with one gunshot wound to the head and one to the chest and the .357 Magnum nearby used to kill her. Busch pleaded not guilty Nov. 21.

Judge Steven Sanders fixed the new date for the preliminary setting to 1 p.m. Jan. 14, noting that Busch's bail remains at $1 million.

Sanders also stated that Busch, who was on probation for domestic violence at the time of the shooting, would have the preliminary hearing for her suspected probation violation at the same time.

Padilla also requested a protective, no-contact order between Cheryl Busch and her husband John Busch. Sanders granted the request and ordered Busch to avoid any contact and stay at least 100 yards away from her estranged husband.

Busch remains in custody at the San Benito County Jail in lieu of her bail.
